Terms of Service

1. Acceptance of Terms

By accessing or using NodeMesh ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you may not use the Service.

These Terms apply to all users including visitors, registered accounts, and paying subscribers. Your continued use after any changes constitutes acceptance of the revised Terms.

2. Description of Services

NodeMesh provides a game server management control plane that enables users to operate game servers on their own hardware ("Bring Your Own Host"). The Service includes:

• A web panel for creating, configuring, and managing game server instances
• A lightweight agent installed on user-owned hardware
• An optional traffic proxy for NAT bypass and IP privacy
• Automated updates, backups, and monitoring tools

3. Bring Your Own Host (BYOH)

You are solely responsible for the hardware on which the NodeMesh agent is installed. NodeMesh does not have physical or administrative access to your hardware beyond the capabilities of the agent. You must ensure your hardware and network connection meet the minimum requirements for the game servers you operate.

Agent scope: The agent only accesses files and processes within the NodeMesh data directory (/opt/nodemesh/ on Linux). It does not access, read, or transmit any other files on your system.

4. Account Registration

You must have a Discord account to register for NodeMesh. You are responsible for maintaining the confidentiality of your session and for all activities under your account. You agree to notify us immediately of any unauthorised use.

You must be at least 13 years of age to use the Service. If you are under 16, you must have parental consent as required by applicable law.

5. Acceptable Use

You agree not to use the Service to:

• Host game servers that distribute illegal, pirated, or counterfeit software
• Conduct DDoS attacks or use the proxy infrastructure to amplify traffic
• Attempt to breach the security of NodeMesh infrastructure or other users' nodes
• Violate any applicable local, national, or international laws
• Impersonate any person or entity or misrepresent your affiliation

Violation of these terms may result in immediate suspension or termination of your account without refund.

6. Billing and Subscriptions

Paid plans are billed monthly in advance. Prices are listed in USD and may vary by region due to purchasing-power parity adjustments. All prices are exclusive of applicable taxes.

Cancellation: You may cancel your subscription at any time. You will retain access to paid features until the end of the current billing period. We offer a 7-day refund on new subscriptions upon written request.

Non-payment: If payment fails, we will notify you and attempt to retry. After 7 days of failed payment, paid services (extra BYOH nodes, cloud servers) may be suspended until balance is restored.

7. Data and Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your data. By using the Service you consent to the practices described in that policy.

8. Intellectual Property

The NodeMesh platform, web panel, and associated code are owned by NodeMesh and protected by applicable intellectual property laws. The agent binary is released under the MIT licence and available at github.com/getnodemesh/agent.

Game software, assets, and mods operated through NodeMesh remain the property of their respective owners. NodeMesh does not grant rights to any game content.

9. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms. You may delete your account at any time from your account settings. Upon deletion, your data is retained for 30 days before permanent erasure.

10. Disclaimers

The Service is provided "as is" without warranty of any kind. We do not guarantee uptime, availability, or fitness for a particular purpose. Game server availability depends on your own hardware and internet connection.

11. Limitation of Liability

To the maximum extent permitted by law, NodeMesh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or in connection with your use of the Service.

Our total liability to you for any claim arising from the Service shall not exceed the amount you paid to NodeMesh in the 3 months preceding the claim.

12. GDPR Rights

If you are located in the European Economic Area, you have the following rights regarding your personal data:

• Access: request a copy of the personal data we hold about you
• Rectification: correct inaccurate or incomplete data
• Erasure: request deletion of your personal data ("right to be forgotten")
• Portability: receive your data in a machine-readable format
• Objection: object to processing based on legitimate interests

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the email associated with your Discord account and post a notice on the platform. Your continued use of the Service after the effective date constitutes acceptance.
